[img=right]http://www.macfreak.nl/base/data/news/images/Motorola-Mobile_logo.jpg[/img]Het Amerikaanse openbaar ministerie (Departement of Justice, of DoJ) heeft de overname van Motorola Mobility door Google goedgekeurd. Opvallend genoeg was één van de redenen dat Google waarschijnlijk weinig aan het beleid van Motorola Mobility zal veranderen omdat ze net zo agressief zijn in het aanvallen van hun concurrenten met patenten, zoals in de verklaring van het DoJ te lezen is.

The evidence shows that Motorola Mobility has had a long and aggressive history of seeking to capitalize on its intellectual property and has been engaged in extended disputes with Apple, Microsoft and others.  As Google’s acquisition of Motorola Mobility is unlikely to materially alter that policy

En dat lijkt vooral interessant omdat Google's CEO Larry Page eerder schreef dat Google Motorola Mobility vooral heeft gekocht om zich tegen het boze Apple en Microsoft te beschermen.

In het onderzoek kwam ook naar voren dat Google minder duidelijk is dan Apple en Microsoft over de manier waarop ze de zogenaamde standard-essential patenten (SEP) willen gebruiken.

During the course of the division’s investigation, several of the principal competitors, including Google, Apple and Microsoft, made commitments concerning their SEP licensing policies.  The division’s concerns about the potential anticompetitive use of SEPs was lessened by the clear commitments by Apple and Microsoft to license SEPs on fair, reasonable and non-discriminatory terms, as well as their commitments not to seek injunctions in disputes involving SEPs.  Google’s commitments were more ambiguous and do not provide the same direct confirmation of its SEP licensing policies.

Mede gezien het verhaal van Google's CEO, en het 'open' mantra wat Google te pas en te onpas bezigt, lijkt het tijd dat Google zich duidelijker uitlaat wat betreft het gebruik van deze patenten. Het DJ blijft Google in ieder geval in de gaten houden.

In light of the importance of this industry to consumers and the complex issues raised by the intersection of the intellectual property rights and antitrust law at issue here, as well as uncertainty as to the exercise of the acquired rights, the division continues to monitor the use of SEPs in the wireless device industry, particularly in the smartphone and computer tablet markets.  The division will not hesitate to take appropriate enforcement action to stop any anticompetitive use of SEP rights.

En dat zou misschien wel eens een erg positief punt kunnen zijn voor Apple, dat op dit moment verwikkeld is in een stevige dispuut met Motorola Mobility in de rechtszaak waarbij Motorola wel erg grote claims baseert op FRAND patenten. Die rechtszaak diende tot voor kort alleen in Duitsland, maar Apple heeft die nu ook in de V.S. aanhangig gemaakt.

Het akkoord voor deze overname kwam trouwens niet alleen van het Amerikaanse DoJ, ook de EU heeft weliswaar het groene licht gegeven voor deze overname, maar houdt Google ook in de gaten, getuige deze woorden van EU Commissaris Joaquin Almunia:

This merger decision should not and will not mean that we are not concerned by the possibility that, once Google is the owner of this portfolio, Google can abuse these patents, linking some patents with its Android devices. This is our worry.
