Als je tegenwoordig de aandacht wilt trekken voor een nieuwsbericht in de media dan zet je de naam Apple in de titel en je weet zeker dat die aandacht er vanzelf komt. Het is alleen wel jammer dat zelfs een krant als The New York Times meent zulke trucjes nodig te hebben. Want afgelopen weekend publiceerden zij een artikel met als titel How Apple Sidesteps Billions in Taxes.

Als je het stuk doorleest zie je al snel dat het hier om een legale manier van belastingontduiking gaat, namelijk door je geld te parkeren op plekken als Luxemburg, Ierland en The Virgin Islands. En ook dat Apple beslist niet de enige is die dit doet, in de zevende alinea worden bijvoorbeeld Google, Amazon, Hewlett-Packard en Microsoft ook genoemd.

En het is natuurlijk wel een onderwerp dat veel Amerikanen bezig houdt:

Geeft maar weer eens aan hoe goed het met Apple gaat.  
Apple is kennelijk gelijk aan sex. Stop sex (Apple) in je titel en je hebt als krant meteen de volle aandacht van de lezer.

Tuurlijk staat Apple in de spotlights. Dat was ook hetzelfde zo met Microsoft, Google en Facebook.

Dan ben je gewoon een easy target. Ben overigens wel zeer benieuwd naar hoe Apple met dit soort publiciteit gaat omgaan daar waar de andere guys altijd een soort van Mea Culpa gingen doen, hoop ik dat Apple anders gaat reageren. Als in, wat minder Corporate....

Ook al is hier Apple de gebeten hond wil dat niet zeggen dat er niets aan de hand is.

Ik snap de titel niet, waar lees je dat de US de regels aan wil gaan passen?
Ik kan dat niet uit je nieuwsbericht halen en tsja, het verhaal klopt wel, Apple ontwijkt de belastingen, net als alle grote bedrijven waar al eerder over geschreven is.

Legaal, betekent niet dat het niet verwerpelijk is.

Jammer dat de 'retractie' van de NYT niet aan bod is gekomen — ze blijken gebruik te hebben gemaakt van cijfers uit een aangifte van Apple die gebruik maakt van de mogelijkheid om de laagste van twee omzetcijfers te hanteren (even simpel gesteld, of die van vorig jaar of die van dit jaar), die na afsluiten van het boekjaar bijgesteld wordt naar de werkelijke omzet.

Apple betaalt in werkelijkheid iets van 24% belasting over de verdiensten in de VS. Dat is heel iets anders dan de genoemde cijfers.

Het artikel is nog steeds te bereiken via de link van Robert. Er wordt geen enkel gewag gemaakt dat het zou zijn ingetrokken. Ik kan op de site van de NYT ook niets van een 'retractie' van dat artikel terugvinden.

Earlier in this day, we reported on a New York Times piece in which the paper claimed that Apple was using a variety of measure to avoid paying U.S. income tax. It turns out that the Times based key pieces of its information on a study that had been discredited two weeks prior.

The data used by the Times included a report by the Greenlining Institute, which made errors in computing Apple’s supposed tax rate at 9.8% for the 2011. The data used by the report effectively compared Apple’s 2011 profit with taxes paid by the company for profits in 2010 and drew unfounded conclusions as a result.

The accounting error had to do with how corporations are required to pay estimated income taxes on a quarterly basis. As Forbes explained when it initially discredited the Greenlining report and again this morning, the IRS tells corporations to make those estimated payments based on either the current year’s expected profit or last year’s actual profit – whichever is lower.

Because Apple has seen tremendous growth over the past two years (much of it a result the iPad), the 2010 actual profits were the lower of the two by a pretty significant margin. That means that any estimated payments made during 2011 were being made based on Apple’s tax bill for 2010. At the end of the tax year, the company paid the difference between its estimated payments and the actual taxes owed.

What’s surprising is that the Times went ahead with numbers from Greenlining without double-checking them. Even something as simple as checking Apple’s 10K statement (PDF link) shows Apple’s estimate of its tax rate, which was 24.2% for 2011 (and 24.4% for 2010). That’s a good deal more than 9.8% – a discrepancy should have led to further investigative work and/or independent number crunching.

Of course, this means that the math and some basic data about Apple’s taxes was wrong, but it doesn’t overturn the primary assertion made by the Times – that Apple is stashing a sizable portion of its profits abroad. As I said earlier today, that’s an issue that goes beyond Apple as many multinational companies do the same thing – and, like Apple, are allowed to do so under U.S. laws.

De bron heb ik niet onderzocht, maar dit lijkt me toch vrij duidelijk.

Dank je voor je reactie bert! Punt wordt nu om na te gaan wat er wel waar is en wat niet?. Wat moet je nu geloven. Heeft de NYT het bij het rechte eind of is het deze keer Cult of Mac? Veiligste is natuurlijk om niemand op hun blauwe ogen te geloven en alleen op verifieerbare feiten af te gaan.

In deze kwestie is dat voor mij niet mogelijk. Wanneer ik dan naar de reputaties van beide bronnen kijk ben ik eerder geneigd om de NYT serieus te nemen dan Cult of Mac. Maar ik ben natuurlijk ook maar een leek
